Are Packspod Vapes Banned? Here’s Everything You Need to Know

WARNING: This product contains nicotine. Nicotine is an addictive chemical.

Short answer: there is no federal order that names Packspod and bans it. But Packspod has never had FDA marketing authorization, which makes it illegal to sell anywhere in the United States, and since September 1, 2025 it has been a criminal offense to sell it in Texas under a state law aimed at exactly this kind of device. That is why it has disappeared from licensed shelves, including ours. The details, with dates and sources, are below.

What “banned” means for a vape

People use “banned” to mean two different things, and the answer depends on which one you mean.

Federal authorization. Since 2016, every e-cigarette sold in the US has needed marketing authorization from the FDA, granted through a premarket review. As of August 28, 2026 the FDA has authorized 48 e-cigarette products in total, from five companies (Vuse, NJOY, Logic, Juul and Glas). None of them is a disposable. Until May 2026 every one of them was tobacco or menthol flavored; the first fruit flavors, two Glas pods, were authorized on May 5, 2026, and only with a device that locks to an age-verified phone. Every other e-cigarette on the market, which is nearly every disposable you have ever seen in a store, is in the FDA’s words “marketed unlawfully and subject to enforcement action at FDA’s discretion.” The agency enforces that through warning letters (more than 800 to manufacturers and importers and more than 1,000 to retailers so far), civil penalties, import detentions and seizures, rather than through named bans.

State and local bans. Separately, a growing list of states prohibit specific categories of vape outright, most often flavored ones, or keep a registry of products that may be sold and remove everything else. These are real bans with real penalties, and they are where a product like Packspod actually gets taken off shelves.

Where Packspod stands federally

Packspod is a line of disposable nicotine vapes sold under the Packwoods brand, a California company better known for cannabis pre-rolls. The devices hold about 12 mL of nicotine salt e-liquid at 5% (50 mg/mL), have a rechargeable battery, and were sold in more than a dozen flavors with names like Marshmallow Fluff and Guava Bubblegum.

Packspod does not appear on the FDA’s list of authorized products, and we could not find any premarket application for it. That puts it in the unauthorized category described above: illegal to sell, with enforcement at the FDA’s discretion. We also could not find an FDA warning letter, seizure or import alert that names Packspod specifically as of the date above. (An October 2024 FDA warning letter went to a retailer trading as “Packs Pod,” but it concerned a different brand’s devices, not this product.) So, federally, Packspod is not “banned” in the sense of a named order. It is unlawful to sell in the same way that Elf Bar, Geek Bar, Lost Mary and the rest of the disposable category are unlawful to sell.

Texas: illegal to sell since September 1, 2025

This is the one that matters most for Saucey, because Texas is where we deliver tobacco and nicotine products. Texas Senate Bill 2024, in effect since September 1, 2025, makes it a Class A misdemeanor (up to a year in jail and a $4,000 fine) to market or sell an e-cigarette product that:

• is manufactured or filled in China or another country the US designates as a foreign adversary, which covers nearly the entire disposable category;
• is designed to look like food, candy, a school supply, a phone or a toy, or is marketed with cartoon characters, celebrity endorsements or food and candy imagery;
• contains cannabinoids, alcohol, kratom, kava, mushrooms or tianeptine.

A disposable sold in flavors called Marshmallow Fluff, Unicorn Sherbert and Sour Gushers, with packaging to match, falls under the second prong on its own. The law criminalizes selling and marketing, not possession; there is no offense in owning one you already have.

Other states

Outside Texas the picture is a patchwork, but Packspod is caught by most of it:

• Flavor bans. California, Massachusetts, New Jersey, New York and Rhode Island prohibit the sale of flavored e-cigarettes (California and Massachusetts include menthol; New York allows it). A candy-flavored disposable cannot legally be sold in any of them.
• Directory laws. Florida, North Carolina, Wisconsin and a growing number of other states now require every vape sold in the state to be on an official directory, which in practice means it has to have FDA authorization or a pending application on file. Products not on the list are removed from shelves and retailers are fined for stocking them. Packspod is not on those lists.
• Cities. Many cities, including several in states with no state-level ban, have their own flavored-tobacco ordinances that cover disposables.

What that means in practice

If you are trying to buy a Packspod from a licensed retailer, you will not find one. Online sellers that still list it are selling an unauthorized product, and in Texas and the states above they are breaking state law as well; that is their exposure, and buyers should know what they are dealing with. If you already have one, no state we are aware of makes it an offense to possess it.
